1. Agreement to Our Legal Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you (whether personally or on behalf of an entity) ("you" or "Client") and TradieWebsites ("we," "us," or "our"), a sole trading business operating in the United Kingdom, concerning your access to and use of our website located at http://www.tradiewebsites.co.uk (the "Site") and the services we provide (collectively, the "Services").
Our Services include:
- Web design and development
- Google Business setup
- SEO audit and technical optimisation
- Web hosting and maintenance

By accessing the Site or engaging our Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not use our Services.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Site with an updated "Last updated" date. Your continued use of the Services after any changes constitutes acceptance of the revised Terms. We recommend reviewing these Terms periodically.
The Services are intended for users who are at least 18 years old. By using our Services, you represent that you are of legal age to form a binding contract.
We recommend that you print or save a copy of these Terms for your records.
2. Services Description
2.1 Service Offerings
We provide the following services to UK-based tradespeople and businesses:
Web Design & Development: Custom website design and development tailored to your business requirements, including responsive design, content management systems, and frontend/backend development.
Google Business Setup: Configuration and optimisation of your Google Business Profile to improve local search visibility.
SEO Audit & Technical Optimisation: Comprehensive analysis of your website's search engine optimisation, including technical SEO improvements, performance optimisation, and recommendations.
Web Hosting & Maintenance: Ongoing website hosting, security updates, backups, technical support, and maintenance services.
2.2 Pricing
All pricing for our Services is published on our pricing page at http://www.tradiewebsites.co.uk/pricing, which shall constitute the most current and accurate pricing information. Prices are subject to change at our discretion, but any changes will not affect orders already confirmed or subscriptions already in effect.
All prices are quoted in British Pounds (GBP) and are exclusive of VAT unless otherwise stated. Where applicable, VAT will be added to the total amount due.
3. Service Delivery Terms
3.1 Project Scope and Timeline
Upon engagement, we will provide you with a project scope outlining deliverables, timelines, and any specific requirements. Timelines are estimates and may be subject to change based on project complexity, client feedback cycles, and provision of required materials.
3.2 Client Responsibilities
You agree to:
- Provide all necessary materials, content, images, and information required for project completion in a timely manner
- Respond to requests for feedback and approval within reasonable timeframes
- Ensure you have the legal right to use any materials you provide to us
- Provide accurate and complete information for Google Business setup and other services
3.3 Delays
Delays caused by late provision of materials, delayed feedback, or changes to project scope may result in extended delivery timelines. We are not liable for delays caused by circumstances beyond our reasonable control.
3.4 Revisions
The number of revision rounds included in each service package will be specified in your project agreement. Additional revisions beyond the agreed scope may incur additional charges at our standard hourly rate.
3.5 Project Completion and Acceptance
Upon completion, you will be provided with an opportunity to review the deliverables. You must notify us of any issues within 7 days of delivery. Failure to provide feedback within this period will constitute acceptance of the work.
4. Payment Terms
4.1 Payment Schedule
Payment terms will be specified in your individual service agreement and may include:
- Full payment in advance for smaller projects
- Deposit (typically 50%) with balance due upon completion for larger projects
- Monthly or annual payments for subscription services
4.2 Accepted Payment Methods
We accept payment via bank transfer, credit card, debit card, and other payment methods as specified during checkout.
4.3 Late Payment
Invoices are due within 14 days of the invoice date unless otherwise specified. Late payments may incur interest at a rate of 8% per annum above the Bank of England base rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
4.4 Withholding of Services
We reserve the right to withhold delivery of services or access to hosted websites until payment is received in full. Non-payment may also result in suspension or termination of hosting services.
5. Hosting & Maintenance Subscriptions
5.1 Subscription Services
Our Hosting & Maintenance services are available as optional monthly or annual subscriptions. These services include:
- Website hosting on secure servers
- Regular security updates and patches
- Automated backups
- Technical support
- Performance monitoring
- Minor content updates (subject to fair usage policy)
5.2 Free Trial Period
Clients who purchase a website design and development package receive a 30-day free trial of our Hosting & Maintenance services commencing upon website launch. During this trial period, you will receive full hosting and maintenance services at no charge.
5.3 Subscription Activation
Following the free trial period, you may choose to subscribe to continue receiving Hosting & Maintenance services. If you do not activate a paid subscription before the trial expires, hosting and maintenance services will be suspended, and your website may become inaccessible.
5.4 Billing and Renewal
Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan. Subscriptions do not automatically renew. We will contact you prior to the end of your subscription term to offer renewal. You must actively confirm renewal to continue services.
5.5 Cancellation
You may cancel your Hosting & Maintenance subscription at any time by providing written notice via email to contact@tradiewebsites.co.uk. Cancellation will take effect at the end of your current paid subscription period, provided payment for that period has been received in full.
No refunds will be issued for unused time within a subscription period. You remain responsible for payment of the current subscription period even after submitting a cancellation notice.
5.6 Suspension for Non-Payment
Failure to pay subscription fees by the due date may result in immediate suspension of hosting and maintenance services. We reserve the right to terminate your subscription and remove your website from our servers if payment remains outstanding for more than 30 days.
6. Refunds Policy
6.1 Website Design & Development Services
All sales of website design, development, SEO audits, Google Business setup, and other non-subscription digital services are final and non-refundable once work has commenced. By engaging our services, you acknowledge that we will begin work promptly upon project confirmation and payment.
6.2 Subscription Services
Hosting & Maintenance subscriptions may be cancelled at any time as set out in section 5.5, but no refunds will be issued for unused portions of a subscription period.
6.3 Consumer Rights (UK)
If you are a consumer (i.e., an individual acting for purposes outside your trade, business, craft, or profession), you have certain rights under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, including a 14-day cooling-off period.
However, if you request that we begin work on your project within the 14-day cancellation period, you expressly agree that you waive your right to cancel once we have fully performed the service. If you cancel after work has begun but before completion, you will be charged for work completed in proportion to the total contract price. For digital content (including website files, designs, and code), you lose the right to cancel once we begin delivery if you have given your express consent and acknowledged that you lose your cancellation right.
6.4 Faulty Services
Nothing in this refunds policy affects your statutory rights as a consumer. If our services are not performed with reasonable care and skill, you may be entitled to remedies under the Consumer Rights Act 2015.
7. Intellectual Property Rights
7.1 Ownership of Deliverables
Upon receipt of full payment for website design and development services, you will own the final website design and custom code created specifically for your project. This includes the right to use, modify, and display the website for your business purposes.
7.2 Third-Party Components
Websites may incorporate third-party components, including but not limited to:
- WordPress core software and plugins
- Premium themes or builders
- Stock images or fonts
- Third-party APIs and integrations
These components remain subject to their respective licenses. You are responsible for complying with all third-party license terms. We do not transfer ownership of these components to you.
7.3 Our Retained Rights
We retain ownership of:
- Our general methodologies, processes, and techniques
- Template code and reusable components developed by us
- Any pre-existing intellectual property used in your project
We reserve the right to use general knowledge, skills, and experience gained from your project in our future work.
7.4 Portfolio Rights
Unless you expressly request otherwise in writing, we reserve the right to display your completed website in our portfolio, case studies, and marketing materials. We may include your business name, website URL, and project description.
7.5 Client-Provided Materials
You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions for any content, images, logos, or other materials you provide to us. You grant us a license to use these materials solely for the purpose of delivering the Services.
You agree to indemnify and hold us harmless from any claims arising from your provision of materials that infringe third-party intellectual property rights.
8. Liability and Indemnification
8.1 Limitation of Liability
To the fullest extent permitted by law:
We shall not be liable for:
- Loss of profits, revenue, business, or anticipated savings
- Loss of data or information
- Loss of business opportunity, goodwill, or reputation
- Any indirect, consequential, special, or punitive damages
Our total liability to you in connection with the Services, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total fees paid by you to us in the 12 months preceding the claim.
8.2 Exceptions to Limitation
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot be excluded or limited under English law
8.3 Website Performance
While we strive to ensure websites we develop are functional, secure, and perform well, we do not guarantee:
- Uninterrupted access or error-free operation
- Compatibility with all future browsers, devices, or technologies
- Specific search engine rankings or traffic levels
- Complete protection against security breaches or hacking attempts
8.4 Third-Party Services
We are not liable for the performance, availability, or functionality of third-party services, plugins, hosting providers (where not provided by us), domain registrars, or other external services integrated into your website.
8.5 Your Indemnification
You agree to indemnify, defend, and hold harmless TradieWebsites, its contractors, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
- Your breach of these Terms
- Your use of the Services
- Content you provide to us
- Your violation of any third-party rights, including intellectual property rights
- Your violation of any applicable laws or regulations
9. Data Protection and Privacy
9.1 Data Processing
In providing our Services, we may process personal data about you and your customers. We are committed to protecting your privacy and complying with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
9.2 Privacy Policy
Our collection, use, and processing of personal data is governed by our separate Privacy Policy, available at http://www.tradiewebsites.co.uk/privacy-policy. By using our Services, you also agree to the terms of our Privacy Policy.
9.3 Your Responsibilities
If your website collects personal data from visitors (through contact forms, newsletter signups, e-commerce transactions, etc.), you are responsible for:
- Complying with all applicable data protection laws
- Providing appropriate privacy notices to your website visitors
- Obtaining necessary consents
- Implementing appropriate security measures
- Responding to data subject requests
We can provide guidance on data protection best practices, but ultimate compliance responsibility rests with you as the data controller.
9.4 Data Security
We implement appropriate technical and organisational measures to protect data against unauthorised access, loss, or destruction. However, no internet transmission is completely secure, and we cannot guarantee absolute security.
10. Website Maintenance and Support
10.1 Scope of Maintenance
For clients with active Hosting & Maintenance subscriptions, we provide:
- Regular software updates and security patches
- Automated daily backups with 30-day retention
- Server monitoring and uptime management
- Technical support via email during business hours
- Minor content updates (limited to a fair usage policy of approximately 1 hour per month)
10.2 Excluded from Maintenance
The following are not included in standard maintenance and may incur additional charges:
- Major redesigns or functionality changes
- Custom development work
- Content migration or extensive content updates
- Recovery from client-caused issues (e.g., accidental deletions)
- Issues arising from unauthorised modifications to the website
- Third-party plugin or service issues beyond our control
10.3 Support Response Times
We aim to respond to support requests within 1-2 business days. Urgent issues affecting website availability will be prioritised. Support is provided during UK business hours (Monday to Friday, 9:00 AM to 5:00 PM GMT).
10.4 Website Backups
While we perform regular automated backups, you are ultimately responsible for maintaining your own backup copies of your website content. We are not liable for data loss, though we will make reasonable efforts to restore from backups where available.
11. Termination
11.1 Termination by You
You may terminate your use of the Services at any time by:
- Cancelling any active subscriptions as set out in section 5.5
- Ceasing to use our Services
- Providing written notice of termination to contact@tradiewebsites.co.uk
11.2 Termination by Us
We may terminate or suspend your access to the Services immediately, without prior notice, if:
- You breach these Terms
- You fail to pay amounts due
- We reasonably believe your use of the Services poses a security risk or violates applicable laws
- We decide to cease offering the Services (with reasonable notice where practicable)
11.3 Effect of Termination
Upon termination:
- Your right to access hosted services will cease immediately
- You remain liable for all charges incurred up to the termination date
- We may delete your data from our servers after a reasonable period (typically 30 days)
- Sections of these Terms that by their nature should survive (including liability limitations, intellectual property provisions, and dispute resolution) will continue to apply
11.4 Data Retrieval
Upon termination, you may request a copy of your website files and database. We will make reasonable efforts to provide this data in a standard format within 30 days of your request, subject to payment of any outstanding fees.
12. Dispute Resolution
12.1 Informal Resolution
If you have any concerns or disputes regarding the Services, we encourage you to contact us first at contact@tradiewebsites.co.uk. We will make good faith efforts to resolve the matter informally.
12.2 Mediation
If we cannot resolve a dispute informally within 30 days, both parties agree to attempt to resolve the dispute through mediation before pursuing litigation. The mediation will be conducted by a mutually agreed mediator or mediation service.
12.3 Legal Proceedings
If mediation is unsuccessful or inappropriate for the dispute, either party may commence legal proceedings.
13. Governing Law and Jurisdiction
These Terms and any disputes or claims arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of England and Wales.
Both parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter.
14. General Provisions
14.1 Entire Agreement
These Terms, together with our Privacy Policy and any project-specific agreements, constitute the entire agreement between you and TradieWebsites regarding the Services and supersede all prior agreements and understandings.
14.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
14.3 Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us.
14.4 Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms to any successor or affiliate without restriction.
14.5 Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemics, government actions, or failures of third-party services.
